California Judge Reinstates Ban on High Capacity Magazines

SACRAMENTO: April 4, 2019. Citing the California Attorney General’s appeal to Judge Roger Benitez’s ruling on the constitutional legality of owning high-capacity magazines, Judge Benitez ruled in favor of a permanent injunction against the sale of high-capacity magazines until such time a higher court resolves the issue:

Both parties indicate in briefing that persons and business entities in Californiamay have manufactured, imported, sold, or bought magazines able to hold more than 10 rounds since the entry of this Court’s injunction on March 29, 2019 and inreliance on the injunction. Indeed, it is the reason that the Attorney General seeks urgent relief in the form of a stay pending appeal. Both parties suggest that it isappropriate to fashion protection for these law-abiding persons.

THEREFORE, IT IS HEREBY ORDERED that the Judgment is stayed in partpending final resolution of the appeal from the Judgment. Federal Judge Rules California Ban on High-Capacity Firearms Unconstitutional

On Friday, March 29, 2019, a federal judge ruled that California’s ban on is unconstitutional:

High-capacity gun magazines will remain legal in California under a ruling Friday by a federal judge who cited a home invasion where a woman used the extra bullets in her weapon to kill an attacker and two other cases women without additional ammunition ran out of bullets.

“Individual liberty and freedom are not outmoded concepts,” San Diego-based U.S. District Judge Roger Benitez wrote. He called the law that would have banned possessing any magazines holding more than 10 bullets unconstitutional.  Fox News, Associated Press
